Analysing over 400 cases on GATT-related matters before Brazilian courts in the period between 2014-2018, Luciane Amaral Corrêa Münch, Federal Judge at the Federal Court of Appeals of the Fourth Region in Brazil and a PhD candidate at UNIGE brings her contribution to the debate about the consistency in interpreting the international law.
Domestic courts play an important role in enforcing and developing international law. Their engagement with international law has increased, and their rulings have outnumbered those of international courts and tribunals in several areas. However, many international legal scholars worry that domestic courts’ rulings can cause fragmentation of international law. Moreover, they argue that domestic courts must use treaty interpretation methods to achieve consistency in interpreting international law.
Analysing over 400 cases on GATT-related matters before Brazilian courts in the period between 2014-2018, this paper contributes to this debate.
